Full legalization and regulation of cannabis with the tax proceeds going into education, infrastructure and healthcare

Establish Louisiana cannabis control commission which shall consist of 5 commissioners: 1 of whom shall be appointed by the governor and shall have a background in public health, mental health, substance use or toxicology; 1 of whom shall be appointed by the attorney general and shall have a background in public safety; 1 of whom shall be appointed by the treasurer and shall have experience in corporate management, finance or securities; and 2 of whom shall be appointed by a majority vote of the governor, attorney general and treasurer, 1 of whom shall have professional experience in oversight or industry management, including commodities, production or distribution in a regulated industry and 1 of whom shall have a background in legal, policy or social justice issues related to a regulated industry. The treasurer shall designate the chair of the commission. The chair shall serve in that capacity throughout the term of appointment and until a successor shall be appointed.

Allow adults ( over 21) in the State may possess marijuana, consume it in private or state-licensed premises, and cultivate it personal use.

Authorize adults in the State to purchase cannabis from state-licensed retailers and enables adults to engage in state-licensed cannabis commerce, including cultivation, manufacturing (extracts and marijuana-infused product production), transportation between licensees, and retail sales.

Impose an excise tax upon the sale of marijuana or marijuana products by a marijuana retailer to anyone other than a marijuana establishment at a rate of 10.75 per cent of the total sales price received by the marijuana retailer as a consideration for the sale of marijuana or marijuana products. The excise tax shall be levied in addition to any state tax.

A city or town may impose a local sales tax upon sale or transfer of marijuana or marijuana products by a marijuana retailer operating within the city or town to anyone other than a marijuana establishment at a rate not greater than 3 percent of the total sales price received by the marijuana retailer as a consideration for the sale of marijuana or marijuana products. The marijuana retailer shall pay the local sales tax imposed under this section to the commissioner at the same time and in the same manner as the sales tax due to the State

State sales tax collected will be allocated in the following ways: 10% allocated to local governments, 25% percent to support public schools and universities throughout the state, a further 25% for general and mental health programs and the remainder remitted to the State general fund.
